Terms of Service
Effective September 11, 2026
These Terms of Service (“Terms”) are a legal agreement between you and Farther Shore LLC, a Washington limited liability company (“Farther Shore,” “we,” or “us”). They govern your use of our website at farthershore.ai, our web and software-as-a-service applications, our iOS and Android mobile apps, and other services that link to these Terms (together, the “Services”).
Accepting These Terms
By accessing or using the Services, creating an account, or clicking to accept these Terms, you agree to them. Our Privacy Policy explains how we handle your personal information. If you do not agree, do not use the Services.
If you use the Services on behalf of an organization, you represent that you have authority to bind it to these Terms, and “you” includes that organization. Some Services may have additional terms that we present to you. Those terms become part of these Terms and control for that Service if they conflict.
Eligibility
- You must be at least 13 years old, or older if your country requires a higher minimum age to consent to online services.
- If you are under the age of majority where you live, your parent or legal guardian must review and agree to these Terms on your behalf and is responsible for your use of the Services.
- If you access the Services through a school, employer, or other organization, its terms and policies also apply, and it may be able to manage, access, or delete your account. Some Services may be offered to students under 13 through their school with appropriate consent, as described in our Privacy Policy.
- You may not use the Services if applicable law bars you from doing so or if we previously terminated your account.
Your Account
You agree to provide accurate account information and keep it up to date, keep your sign-in credentials secure, and not share your account unless a Service allows shared or team accounts. You are responsible for all activity under your account. Notify us promptly at support@farthershore.ai if you suspect unauthorized access. You may delete your account at any time, as described in our Privacy Policy.
Acceptable Use
You agree not to, and not to help anyone else to:
- Violate any law or anyone’s intellectual property, privacy, or other rights.
- Upload or generate content that is unlawful, harassing, hateful, threatening, defamatory, sexually exploits minors, or is intentionally deceptive.
- Upload personal information about others without the legal right to do so.
- Introduce malware, probe or test the vulnerability of the Services, or circumvent security measures, usage limits, or safeguards on AI features.
- Access the Services through bots, scrapers, or other automated means, except through interfaces we provide for that purpose.
- Reverse engineer, decompile, or disassemble the Services, except where applicable law expressly permits it.
- Disrupt or place an unreasonable load on the Services or their infrastructure.
- Impersonate anyone or misrepresent your affiliation with anyone.
- Resell, sublicense, or commercially exploit the Services without our written permission, or use them to build a competing product.
- Present AI-generated output as human-created where doing so would be deceptive.
We may investigate suspected violations and take appropriate action, including removing content, suspending or terminating accounts, and cooperating with law enforcement.
Your Content
You own Your Content. “Your Content” means the text, files, images, audio, prompts, and other material you submit to the Services. We do not claim ownership of it.
License to operate the Services. You grant Farther Shore a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit, display, and adapt (for example, reformat) Your Content only as needed to operate, provide, secure, and improve the Services and as described in our Privacy Policy. Our service providers, including AI model providers, may do the same on our behalf. This license ends when you delete Your Content or your account, except for temporary backup copies, content you shared that others have copied, and content we must keep by law.
No AI training without consent. We will not use Your Content to train or fine-tune AI models made available to others without your consent.
Your responsibility. You represent that you have the rights needed to submit Your Content and grant this license, and that Your Content does not violate these Terms or the law. We do not have to monitor Your Content, but we may remove content we believe violates these Terms. Please keep your own copies of anything important.
Copyright complaints. If you believe content on the Services infringes your copyright, email support@farthershore.ai identifying the work, the location of the material, and your contact information. We may terminate the accounts of repeat infringers.
AI Features
Some Services use artificial intelligence, including models from third-party providers acting on our behalf, to generate text, images, summaries, feedback, or other output (“Output”).
- Ownership. As between you and Farther Shore, and to the extent permitted by law, you own the Output generated for you, and we assign to you any rights we have in it. Output may not be unique, and others may receive similar Output.
- Output may be wrong. AI can produce Output that is inaccurate, incomplete, outdated, biased, or offensive, and it may state incorrect information confidently.
- Not professional advice. Output is not legal, medical, mental health, financial, or other professional advice.
- You are responsible for your use. Evaluate Output before using or sharing it. Do not rely on Output for decisions about yourself or others, especially decisions with legal, financial, educational, employment, health, or similarly significant effects, without appropriate human review.
- Sensitive information. Do not submit sensitive information, such as health information, government ID numbers, financial account numbers, other people’s personal information, or confidential information, unless you are permitted to share it and the feature is designed for it.
- Safety and changes. We may use automated and human review to detect misuse and may block requests or Output that violate these Terms. We may change the models, providers, and capabilities behind AI features at any time.
Our Intellectual Property
The Services, including their software, design, text, graphics, logos, and trademarks, but excluding Your Content, are owned by Farther Shore or our licensors. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the Services for your personal or internal business purposes and to install our mobile apps on devices you own or control. We reserve all other rights. You may not use our name, logos, or trademarks without our written permission. Open-source components are governed by their own licenses.
Feedback
If you send us ideas, suggestions, or other feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use it for any purpose without obligation or compensation to you.
Paid Features and Subscriptions
Pricing and payment. We will show you the price, what is included, and the billing terms before you buy. Prices exclude applicable taxes unless stated. For purchases made directly from us, you authorize us and our payment processor to charge your chosen payment method.
Automatic renewal. Subscriptions renew automatically at the end of each billing period, such as monthly or annually, at the then-current price until you cancel. To avoid being charged for the next period, cancel at least 24 hours before the current period ends. You can cancel subscriptions purchased directly from us in your account settings or by emailing support@farthershore.ai. Cancellation takes effect at the end of the current period, and you keep access until then. We will notify you in advance of any price change, which will apply from your next renewal.
Free trials. Unless you cancel before a free trial ends, your paid subscription will begin and you will be charged. We will show you the trial terms when you sign up.
Purchases through Apple and Google. In-app purchases and subscriptions made through the Apple App Store or Google Play are billed by Apple or Google, not Farther Shore, and are subject to their terms. You must manage and cancel them through your Apple or Google account settings. Deleting the app or your account does not cancel them. Apple or Google handles refund requests for those purchases under its refund policies.
Refunds for direct purchases. Except where required by law or stated at purchase, fees paid directly to us are non-refundable, and we do not provide refunds or credits for partial billing periods. If we discontinue a paid feature you prepaid for, we will refund the unused portion. If you believe you were charged in error, contact support@farthershore.ai.
Third-Party Services
The Services may link to or integrate with services operated by others, such as sign-in providers, app stores, and payment processors. Their own terms govern your use of them, and we are not responsible for their content, availability, or practices.
Consulting Engagements
If you engage Farther Shore for consulting, advisory, training, or development services, a separate written agreement between you and us, such as a services agreement or statement of work, governs that engagement, including deliverables, fees, confidentiality, and ownership of work product. If these Terms conflict with that agreement, the written agreement controls.
Termination
You may stop using the Services at any time and may delete your account as described in our Privacy Policy.
We may suspend or terminate your access to all or part of the Services if you violate these Terms, if required by law, if your use creates risk or legal exposure for us or others, or if we discontinue a Service. Where reasonable, we will notify you first. If we discontinue a Service entirely, we will try to give you advance notice and, where feasible, a chance to export Your Content.
When your access ends, your license to use the Services ends. Provisions that by their nature should survive termination will survive, including those on Your Content, Feedback, Our Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law and Venue, and General Terms.
Disclaimers
THE SERVICES, INCLUDING ALL CONTENT AND OUTPUT, ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, FARTHER SHORE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY CONTENT OR OUTPUT WILL BE ACCURATE, COMPLETE, OR RELIABLE.
Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
- FARTHER SHORE AND ITS MEMBERS, MANAGERS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US $100.
These limitations apply under any legal theory, whether contract, tort (including negligence), strict liability, or otherwise. They do not limit liability that cannot be limited under applicable law.
Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Farther Shore and its members, managers, employees, and agents from any third-party claims, and related losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees), arising out of your misuse of the Services, Your Content, your violation of these Terms, or your violation of any law or the rights of others. We may participate in or control the defense of any such claim, and you may not settle a claim that affects us without our written consent.
Governing Law and Venue
These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. Any such dispute will be brought exclusively in the state or federal courts located in the State of Washington, and you and Farther Shore consent to the personal jurisdiction of those courts. If you are a consumer living outside the United States, nothing in these Terms limits the protection of mandatory consumer laws in your country of residence.
Before filing a claim, we encourage you to contact us at support@farthershore.ai so we can try to resolve the issue informally.
Changes to These Terms
We may update these Terms from time to time and will update the Effective Date when we do. If we make material changes, we will give you reasonable advance notice through the Services, by email, or on our website. Changes will not apply retroactively or to disputes that arose before they took effect. By continuing to use the Services after changes take effect, you agree to the updated Terms. If you do not agree, stop using the Services.
Mobile Apps from Apple’s App Store
This section applies to any Farther Shore app you download from the Apple App Store (an “iOS App”) and controls over the rest of these Terms for the iOS App if they conflict.
- Acknowledgment. These Terms are between you and Farther Shore only, not Apple Inc. (“Apple”). Farther Shore, not Apple, is solely responsible for the iOS App and its content.
- Scope of license. Your license to use the iOS App is limited to a non-transferable license to use it on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the iOS App may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
- Maintenance and support. Farther Shore is solely responsible for providing any maintenance and support services for the iOS App, as described in these Terms or as required by law. Apple has no obligation whatsoever to furnish any maintenance or support services for the iOS App.
- Warranty. Farther Shore is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the iOS App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, of the iOS App to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the iOS App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are Farther Shore’s sole responsibility.
- Product claims. Farther Shore, not Apple, is responsible for addressing any claims by you or any third party relating to the iOS App or your possession and use of it, including (i) product liability claims; (ii) any claim that the iOS App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the iOS App’s use of the HealthKit and HomeKit frameworks. These Terms do not limit Farther Shore’s liability to you beyond what is permitted by applicable law.
- Intellectual property. If a third party claims that the iOS App or your possession and use of it infringes that third party’s intellectual property rights, Farther Shore, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.
- Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Developer contact. Please direct any questions, complaints, or claims about the iOS App to Farther Shore LLC at support@farthershore.ai.
- Third-party terms. You must comply with any applicable third-party terms of agreement when using the iOS App, such as your wireless data service agreement.
- Third-party beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
Apps from Google Play
If you download a Farther Shore app from Google Play, the Google Play Terms of Service also apply to your download and use of that app.
General Terms
- Entire agreement. These Terms, our Privacy Policy, and any additional terms for a specific Service are the entire agreement between you and Farther Shore regarding the Services, except that separate written consulting agreements apply as described above.
- Severability. If any provision is found unenforceable, it will be enforced to the maximum extent permissible or severed, and the rest of these Terms will remain in effect.
- No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, reorganization, or sale of all or part of our business.
- Relationship. These Terms do not create a partnership, joint venture, employment, or agency relationship.
- Events beyond our control. We are not liable for delays or failures caused by events beyond our reasonable control.
- Notices. We may send you notices by email or through the Services. You may send legal notices to support@farthershore.ai. Electronic communications satisfy any requirement that a communication be in writing.
- Interpretation. Headings are for convenience only, and “including” means “including without limitation.”
